RE: The tariff classification of a dietary supplement from Brazil

Dear Ms. Ho:

In your letter dated April 21, 2010, on behalf of Billion Venture International, El Monte, CA, you requested a tariff classification ruling.

The product is a human dietary supplement in the form of a gelatin capsule filled with 500 milligrams of Pfaffia paniculata radix (suma, Brazilian ginseng) powder. The product will be packaged in a bottle containing 60 capsules.

The applicable subheading for this product will be 2106.90.9998, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or included…other…other…other. The rate of duty will be 6.4 percent ad valorem.

Articles classifiable under subheading 2106.90.9998, HTSUS, which are products of Brazil may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
